Lawyers: Boeheim's opinion is protected speech

SYRACUSE, N.Y. -- Lawyers for Jim Boeheim and Syracuse University, are asking that the defamation lawsuit against their clients be dropped, saying that Boeheim's opinion is protected speech.
In papers filed Tuesday, the lawyers argue that comments Boeheim made against two of Bernie Fine's accusers are protected by his constitutional rights to express himself. They are now asking that the case, which has been moved to Syracuse from New York City, be dropped.
Bobby Davis and Mike Lang are suing Boeheim and Syracuse University, saying that Boeheim defamed them by calling them liars after they came forward with sex abuse allegations against former assistant Coach Bernie Fine.
Fine has denied any wrongdoing and has not been charged.
