Oxley to get new trial
OGDENSBURG, N.Y. -- A state court has decided an Ogdensburg man convicted of murder back in 2006 will get the chance to have his case re-heard. The appellate division of state Supreme Court ruled Thursday that St. Lawrence County Court "erred in excluding evidence of third-party culpability" in the murder conviction of Wayne Oxley.

Oxley was sentenced to 25 years to life for the August 2005 murder of Bernie Trickey Jr. But the appellate division's ruling says the courts should have allowed evidence and testimony from a witness who claims to have seen another man, Robert "Chase" Webb at the scene, and threatening the victim just hours before the murder. That witness would have also testified that she heard Chase admit to the murder six months later and describe the exact way it was committed.

Oxley, who says he's innocent, has been in jail for nearly four years.
