Jurors remain undecided in Oxley re-trial

ST. LAWRENCE COUNTY, N.Y. -- The re-trial of an Ogdensburg man accused of murder may be headed for a hung jury. After more than 24 hours of deliberations, jurors in the Wayne Oxley trial issued a statement Monday saying they are, "Still apart and the probability of a unanimous decision is remote."

Oxley is on trial for the beating death of his neighbor, Bernard Trickey Jr., back in 2005. He was convicted of murder in 2006, but it was overturned last year.

Monday, the judge told the jury to continue deliberations and go over all of the testimony and evidence until they've exhausted all options. This came after a day filled with controversy where it was revealed that a juror had brought a cell phone into the deliberation room.
