ST. LAWRENCE COUNTY, N.Y. -- While we continue to wait for the fate of Wayne Oxley to be decided by a jury the judge in the trial has issued an apology for an outburst in court Monday.

Oxley is on trial for the beating death of his neighbor, Bernard Trickey Jr., back in 2005.
He was convicted of murder in 2006, But it was overturned last year.

Monday Judge Jerome Richards yelled at Oxley's lawyer Richard Manning for complaining to the media about court attendants possibly paying too close attention to the jury.

Manning told media outlets Friday he was concerned because court attendants were close enough to hear phones ringing and they were allowed to enter jury chambers.

In his apology Monday Judge Richards said "the manner in which I reacted was undignified."

The jury has been deliberating since the beginning of last week telling the judge on two separate occasions they were deadlocked.

Both times the judge ordered them to continue deliberations.
