CHEMUNG COUNTY, N.Y. -- The man accused of killing Brian Martin on November 8, 2012 took the stand in his own defense Friday. Justin Jones unfolded the events that led up to Martin's death.
According to testimony, Jones used the Trac Phone that was purchased by a friend to call Martin for a ride. Jones put a handgun in his sweatshirt pocket when he left his house to meet Martin, as he put it, 'for protection.'
Jones then invited Martin back to his house to hang out.
As they were inside Jones' living room, they began to talk which escalated into an argument.
Jones testified that when Martin turned away, he pulled out the gun and shot him. He then checked for a pulse and realized he was dead.
Jones continued to say when he was starting to clean up the body, he tried to cut his limbs off to make it easier.
Under cross examination, the prosecution argued Jones and Martin never had previous fights in the past, so they questioned the use of the gun this one time.
The assistant DA also said he had bought the Trac Phone only for this one night.
Martin was found dead in his mother's SUV with his right leg nearly severed off.
The defense wants to lessen the second degree murder charge to first and second degree manslaughter and criminal negligent homicide.
