HERKIMER, N.Y. -- The court battle continues regarding Herkimer County's effort to build a new correctional facility.
The county wants to build on an empty plot of land in the village, but village officials opposed the move. A zoning ordinance was also passed to prevent it from happening.
Last year, the county took the village to court last year, and won. The judge ruled state law superceded local law. It ultimately allowed the county to build wherever they want. The village proceeded to appeal the state ruling.
This week, a judge overruled the original ruling. The State Supreme Court judge sent the case back to county level for further review.
