ALBANY, N.Y. -- Attorney General Andrew Cuomo is responding to a request by DA Soares to publicize Grand Jury testimony from the Troopergate investigation. Governor Paterson has sought his legal opinion, since releasing the information would mean waiving executive privilege on behalf of former Governor Spitzer.

Cuomo says only a court, or Spitzer himself, has the ability to waive grand jury secrecy and he's urging him to do so, saying. "My personal

opinion is that given the unique circumstances presented in this matter, it is in the public interest that the former Governor withdraw his privilege claims for the sake of the public's right to full disclosure and transparency."
