Early this morning members of the New York State Police – Troop D, arrested 3 subjects as a result of the Erin Maxwell investigation. Erin suffered injuries at her residence -1678 Route 264 in Palermo, NY, at approximately 5-00PM on August 29, 2008. She died at University Hospital at approximately 4-00AM on August 30 as a result of these injuries.
Erin’s step-brother, Alan L. Jones, age 27, of 427 Silk Road, Lot #12, Fulton, NY was arrested for Murder in the 2nd Degree as a result of an indictment issued by an Oswego County Grand Jury which alleges that he caused the injuries on August 29 which later resulted in Erin’s death. Murder in the 2nd degree is a Class A-I Felony punishable by a maximum of life in prison.
Erin’s father, Lindsey Warren Maxwell, age 35, also of the Silk Road address, was arrested for Endangering the Welfare of a Child due to the unhealthy living conditions and treatment Erin had been subjected to at the Palermo residence, in the time before her death. Endangering the Welfare of a Child is a Class A misdemeanor punishable by up to a year in jail.
Erin’s step-mother, Lynn D. Maxwell, age 53, of the same Silk Road address, was also charged with Endangering the Welfare of a Child in regards to Erin’s treatment before her death. All three of the defendant’s formerly lived with Erin at the Palermo address.
These arrests are the result of an exhaustive investigation by the State Police, Oswego County District Attorney’s Office and the Onondaga County Medical Examiner’s Office. The State Police would like to thank the McFee Ambulance Service, Palermo Volunteer Fire Department, Oswego County SPCA volunteers, the Phoenix School District, and the Oswego County DSS, for their assistance in this investigation.
