ST. LAWRENCE COUNTY, N.Y. -- A St. Lawrence County man convicted of murder four years ago is now out on bail as he awaits a re-trial later this year.

Wayne Oxley is the man police arrested for murdering his neighbor, Bernard Trickey Jr., in Ogdensburg back in 2005. He was convicted the next year. But that verdict was thrown out after it was determined a judge refused to hear testimony from a witness.

Oxley's re-trial is scheduled for this summer.

The St. Lawrence County District Attorney's office says Oxley was released Monday on $75,000 bail.

Oxley's attorney says he is not a flight risk.
