HERKIMER COUNTY, N.Y. -- A former Village of Frankfort police officer appeared in Herkimer County Court this week to face charges of forgery and official misconduct.

Daniel Herrman is accused of filing two emergency information requests for cell phone records with Verizon with the intent to defraud or deceive another. The indictment says the requests were filed in March of last year while Herrman was a patrolman with the village police.

The assistant district attorney prosecuting the case says the two counts of the indictment alleging official misconduct stem from Herrman being dishonest in listing the reason for the request.

"The basis for making such a request is that you have to be a police officer performing your lawful functions, and there must be an immediate danger of death or other serious physical injury which requires the dissemination of that information from Verizon to a police agency," said Assistant District Attorney Jeff Carpenter.

The indictment says no such danger existed in this case. Herrman is due back in court early next year.
