ST. LAWRENCE COUNTY, N.Y. -- It's trial number three for Wayne Oxley, but new evidence was presented Friday.
Oxley is accused of beating Bernard Trickey Jr. to death with a baseball bat in 2005. The cause of death was determined to be blunt force trauma to the head.
Dr. Michael Sikirica, who took the stand Friday, came to that conclusion when he performed the autopsy several years ago.
During cross examination, Oxley's defense attorney showed a picture from the autopsy that has never been seen before.
The defense argues that in the picture, you can see a hole above Trickey's eye socket, which they claim could potentially be a bullet hole. But Sikirica said there was no evidence to support the theory of a gunshot wound because there was no gun powder residue and no exit wound.
The defense starts calling its witnesses on Monday.
