Judge dismisses case involving First Arena

CHEMUNG COUNTY, N.Y. -- A Supreme Court judge has dismissed the lawsuit against Chemung County over the seizure of First Arena.

The county foreclosed on the property back in February because of unpaid taxes. A lawsuit, filed by the Afr family that leased the arena, claimed the county didn't have the power to buy back a foreclosed property but a judge disagreed.

Wednesday, the case was thrown out. The county executive says he can now move forward with the investigation into how the arena was improperly operated.

"There certainly was an extended period of time in that facility that there was no insurance, no liability insurance, fire insurance, there hasn't been for months and we were told that they recently had put insurance on it but that turns out not to be true," said Chemung County Executive Tom Santulli.

The county executive says he plans to have a report for the legislature by the end of June that includes all of his investigative findings and his recommendations on what to do with the arena moving forward.
