Appeal filed in defamation lawsuit dismissal

UNITED STATES -- As promised last week, attorneys for the plaintiffs in the Jim Boeheim defamation lawsuit have filed an appeal in the case.

Last week, State Supreme Court Judge Brian DeJoseph dismissed the case against the SU head basketball coach and the university.

Bobby Davis and Michael Lang had accused Boeheim of making defamatory statements after the two men came forward, claiming they were abused by long-time assistant coach Bernie Fine. But the judge ruled that the content, tone and purpose of Boeheim's statements would clearly signal to the reasonable reader to be opinion, a biased, passionate and defensive view of a coach rather than objective fact.

Tuesday, attorneys for Davis and Lang filed an appeal to the New York Supreme Court, Appellate division.
