UTICA, N.Y. -- The former State Trooper who broke into a Utica home on New Year's Eve and assaulted the occupants has pleaded guilty to two charges in Oneida County Court.

Jesse Miller pleaded guilty to fourth degree criminal mischief and third degree assault as part of a plea deal. Miller told Judge Barry Donalty he'd been drinking heavily the day of the incident. He says he doesn't remember what happened after he left a Utica pub that night, but prosecutors say he broke down the door of a Beverly Place home and attacked the people inside.

Officials with the District Attorney's office say testing confirmed Miller was extremely intoxicated at the time.

"In view of the fact that he had no prior record, he had military service, he was a State Trooper, we took all these factors into account and felt this was an appropriate punishment, the three years of probation. Obviously there's going to be some alcohol counseling," said Assistant District Attorney Kurt Hameline.

Miller is due back in Oneida County Court July 11 for sentencing.
