SALISBURY, N.Y. -- One person is dead and another is hospitalized following at ATV accident in Herkimer County. It happened on Bingham Mill Road in Salisbury around 6:00 p.m. on Friday.

According to State Police, James Siver, 32, lost control of his ATV and hit a tree. Siver and a passenger, Leah Holtz, 26, were thrown off. Holtz was pronounced dead at the scene. Siver was flown to Saint Elizabeth Medical Center in Utica with leg and pelvis injuries.

Police are still investigating the crash, but they said speed was a factor.
