ONEIDA COUNTY, N.Y. -- A corrections officer accused of assaulting an inmate in 2010 has accepted a plea deal.
Michael Wehby pleaded guilty to a charge of official misconduct Monday morning. It was the one charge that jurors were undecided on after his trial in June.
Wehby was found not guilty of two felony counts of assault relating to the January 2010 beating of inmate Jose Rivera. At the time, Wehby worked as a corrections officer at Mid-State Correctional Facility.
As part of the plea deal, he will have to step down from that position but he won't have to serve any jail time or probation.
Wehby's sentencing is scheduled for mid-November.
