Jury convicts defendants in illegal dumping case

HERKIMER COUNTY, N.Y. -- A jury convicted a Herkimer County property owner and a New Jersey Waste Management Company of conspiring to illegally dump asbestos-contaminated debris in Frankfort. "Cross Nicastro" and "Mazza and Sons Incorporated" were both found guilty of conspiracy to defraud the U.S. and violate the Clean Water Act and Superfund laws.

Prosecutors say more than 60 million pounds of debris was dumped on wetlands owned by Nicastro on Southside Road in Frankfort between June and October of 2006. The defendants concealed the dumping by forging a permit from the DEC and destroying documents relating to a grand jury subpoena.

They could face up to five years in prison on each count.
