ONONDAGA COUNTY, N.Y. -- Two years ago, the race for Congress between democrat Dan Maffei and republican Ann Marie Buerkle was very tight. A long recount gave the win to Buerkle.

Now, Maffei is going to court to ask a state Supreme Court justice to impound all votes in the new 24th Congressional District next Tuesday. A hearing is due on Monday.

The Onondaga County Board of Elections confirms it has been served with papers and is prepared for the court session on Monday.

A spokesman for Maffei refers to the action as, in his words, "a standard practice in potentially close races to ensure a fair and accurate count of every vote."

There was no immediate comment from the Buerkle campaign.
