ITHACA, N.Y. -- The jury is finding it difficult to come to a consensus in the second Corbin Whyte murder trial.

Whyte is charged with two counts of murder, robbery and tampering with evidence in the shooting of Paul Garcia. Garcia was found dead in Ithaca's Maple Hill apartments in December of 2010.

Tuesday marked the third day of deliberations, and the second time jurors told the judge they're deadlocked.

One juror was replaced Tuesday morning by an alternate due to a family emergency, but the switch hasn't yet altered the outcome.

Jurors must agree on all four charges before they can render a verdict. The judge asked them to keep at it, reminding them to have an open mind.

This is the second time Whyte has been on trial for Garcia's murder. The first trial ended in a hung jury.

If they don't reach a verdict, there will likely be a third trial.

Deliberations continue Wednesday.
