ALBANY, N.Y. -- New York State is expected to respond today to a lawsuit that is challenging the SAFE Act gun control laws signed by Governor Cuomo back in January.

Robert Schulz of Warren County is seeking to overturn the gun laws in the state. He won a court order last month that requires the state to explain why the message of necessity was warranted in passing the SAFE Act.

He calls Governor Cuomo a "king" for suspending the three-day review, usually required before votes on bills.

Cuomo, along Assembly Speaker Sheldon Silver and senators Dean Skelos and Jeff Klein, are named in the lawsuit.

The SAFE Act gives New York some of the toughest gun control laws in the country.
